-Overview

The Intro EB-5 Finance WebCourse examines the basic statutes and regulations governing the EB-5 Program. Topics covered include direct EB-5 vs. EB-5 Regional Center programs, minimum investment requirements, securities regulations, and business plans and economic reports. Plus several case study examples will be discussed to showcase the variety of economic development projects that can benefit from this form of capital.

The EB-5 Program is a federal foreign direct investment, immigration, and regional economic development program that provides access to capital to U.S. businesses and creates American jobs at no expense to the American taxpayer. Globalization has spurred an unprecedented rise in wealth overseas, as well as increased the speed of capital between nations. By building immigration benefits into investment incentives, the EB-5 Program provides a welcome avenue for overseas wealth to be delivered to the U.S. economy – tapping into new opportunities and opening a new frontier of development finance programs.

The EB-5 Program has a robust history dating back over 20 years. This first session will explore the origins of the program and development of governing public policy and administrative procedures. Basic terms and structures will be introduced.

Understanding EB-5 Immigration Laws
The immigration laws surrounding the EB-5 Program are multi-faceted and complex. During this session, we will explain the various forms that are used within the program, including DS-230, I-485, I-526, I-829, I-924, and I-924A. In addition, the purpose of each form and their functions within the program will be explained.

The first day of the Intro EB-5 Finance WebCourse looked at the basics of the EB-5 Program and the various laws and policies governing its use. At the start of Day 2, we will review some important terms and set the stage for the remaining sessions focused on the more technical aspects of the program including deal structuring, working with regional centers, and understanding EB-5 trends and statistics.

EB-5 as a Component of the Capital Stack
Financing economic development projects requires a careful structuring of several sources, often including bonds, tax credits, loan funds, and other sources. As EB-5 becomes a more prevalent financing source, understanding how this investment works within the overall capital stack is critical to seeing a project move forward. This session will explain various structures using EB-5, look at how to balance equity vs. loan models, and how the jobs requirement fits into the overall planning process.

Investments succeed and fail every day.
